General Terms of Delivery

I. GENERAL PROVISIONS

1.1. These General Terms of Delivery of PHOENIX Pharma EOOD (hereinafter referred to as the “General Terms”) regulate the relations between PHOENIX Pharma EOOD, on the one hand, and all buyers, on the other. By placing an order for the delivery of goods to PHOENIX Pharma EOOD through the online ordering system, via pharmacy software, or through the dealers of PHOENIX Pharma EOOD, the buyer agrees to and accepts these General Terms.

1.2. PHOENIX Pharma EOOD reserves the right to amend the General Terms, with each amendment taking effect immediately upon its publication on the website www.phoenixpharma.bg. Amendments to the General Terms shall not affect the relations between PHOENIX Pharma EOOD and a buyer that arose prior to the publication of the information about the changes on the website.

II. ORDERS

Buyers place orders for goods by using the program Apteka Expert 2, the program Apteka Expert 2 Central, via the website https://b2b.phoenixpharma.bg/ or by calling the telephone number: 0700 444 44 (charged at the rate of a local call).

III. PRICES

The unit price of the goods is determined in accordance with the valid price list of PHOENIX Pharma EOOD at the time of the order and includes VAT.

IV. DELIVERY

4.1. PHOENIX Pharma EOOD delivers the goods within 24 (twenty-four) hours from receipt of the specific order to the address indicated by the buyer.

4.2. The delivery date shall be deemed the date on which the goods arrive at the buyer, as stated on the tax invoice or handover protocol signed by both parties.

4.3. The handover of the goods is carried out at the site under item 4.1 in the presence of representatives of PHOENIX Pharma EOOD and the buyer. Upon delivery, a tax invoice or handover protocol signed by both parties confirms receipt of the goods.

4.4. For the delivery of certain goods, the buyer must hold the relevant authorization, certificate, and/or license issued by the competent authorities under the applicable Bulgarian legislation. The buyer is obliged to provide PHOENIX Pharma EOOD with a copy of the respective authorization, certificate, and/or license, certified by the buyer as “true to the original,” prior to placing an order for the delivery of the respective goods.

V. PAYMENT TERMS

Payment shall be made in cash upon delivery (in compliance with the restrictions under the Bulgarian Act on Limiting Cash Payments) or in advance by bank transfer.

VI. WARRANTIES

The quality of the goods complies with the manufacturer’s technical standards.

VII. CLAIMS

7.1. Claims for apparent defects shall be accepted within 24 (twenty-four) hours from the date of delivery of the goods.

7.2. Claims for hidden defects shall be accepted within the validity period of the goods.

VIII. PERSONAL DATA

The processing of buyers’ personal data is carried out in accordance with the applicable legislation on personal data protection.
